These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Excelin Web Limited, the company that owns and operates Bisibly, a product provided at bisibly.com and associated subdomains.
By creating an account, accessing, or using Bisibly in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the platform.
You must be at least 13 years of age to use Bisibly. If you are under 18, you represent that you have your parent or guardian's permission to use the platform. If you are using Bisibly on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.
Bisibly is an all-in-one business management platform that provides a suite of tools for entrepreneurs, freelancers, and businesses. The platform includes, but is not limited to:

To access Bisibly's features, you must register for an account. When registering, you agree to:
You are solely responsible for all activities that occur under your account. Bisibly will not be liable for any loss or damage arising from your failure to maintain account security. We reserve the right to suspend or terminate accounts that we suspect are compromised or being misused.
You may not create accounts using automated means or under false pretences. Each person or business entity may register only one primary account unless explicitly authorised by Bisibly.
Bisibly offers several subscription tiers including a Free plan and paid plans (Basic at NZ$20/month and Pro at NZ$49/month). Paid plans are billed on a monthly or annual basis, as selected during checkout.
You may upgrade your plan at any time; the upgrade takes effect immediately and you will be charged a prorated amount. Downgrades take effect at the end of your current billing period. Certain features may become unavailable upon downgrading.
If a payment fails, we will attempt to charge your payment method again. If payment continues to fail, your account may be suspended. You remain responsible for all outstanding fees.
VoltZ Credits ("VoltZ") are Bisibly's AI credit currency used to access AI-powered features on the platform. VoltZ are included with paid subscription plans and can also be purchased as top-up packs.

You agree to use Bisibly only for lawful purposes and in accordance with these Terms. You must not use the platform to:
We reserve the right to investigate and take appropriate action, including account suspension or termination, for any violation of this Acceptable Use Policy.
The Bisibly platform, including its design, software, source code, trademarks, logos, and all content created by Bisibly, is owned by Excelin Web Limited and protected by applicable intellectual property laws.
Subject to your compliance with these Terms, Bisibly grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform for your legitimate business purposes.
You may not copy, modify, distribute, sell, or lease any part of our services or software, nor may you reverse engineer or attempt to extract the source code of our software.
You retain ownership of all content you create, upload, or publish through Bisibly ("User Content"). By submitting User Content, you grant Bisibly a worldwide, non-exclusive, royalty-free licence to use, store, display, and distribute that content solely to provide and improve the service.
You represent and warrant that:
Bisibly does not endorse any User Content and has no obligation to monitor it. However, we reserve the right to remove User Content that violates these Terms or that we deem harmful to the platform or its users.
Your use of Bisibly is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand our practices.
By using the platform, you consent to the collection and use of your information as described in the Privacy Policy. If you are located in the EEA, UK, or other regions with data protection laws, we process your data in accordance with applicable regulations including the UK GDPR.
Bisibly may integrate with or link to third-party services, websites, or applications (such as payment processors, email providers, and social media platforms). These integrations are provided for your convenience and do not constitute endorsement of those third parties.
Your use of third-party services is governed by those parties' own terms and privacy policies. Bisibly is not responsible for the availability, accuracy, or practices of any third-party service. We encourage you to review the relevant terms before using any third-party integration.
The Bisibly platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Bisibly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant that any defects in the platform will be corrected.
To the maximum extent permitted by applicable law, Bisibly's total liability to you for any claims arising from or related to these Terms or your use of the platform shall not exceed the greater of (a) the amount you paid to Bisibly in the twelve (12) months preceding the claim, or (b) NZ$100.
In no event shall Bisibly be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, even if advised of the possibility of such damages.
You may terminate your account at any time by cancelling your subscription and deleting your account through the platform settings or by contacting our support team.
Bisibly may suspend or terminate your account with or without notice if:
Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall survive.
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer in the European Union or another jurisdiction that grants mandatory consumer protections, those protections shall apply in addition to the above.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a prominent notice within the platform at least 14 days before the changes take effect.
Your continued use of Bisibly after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the platform before the changes take effect.
